Terms of Use – SQribe

1. Introduction

Welcome to SQribe, a transcription platform offered by AethiQs B.V. By accessing or using our services, you agree to these Terms of Use. If you do not agree, you must not use SQribe.

2. Definitions

SQribe

The web application and related services for transcription and post-processing.

User

A natural or legal person using SQribe.

B2C

Business-to-Consumer; individual users.

B2B

Business-to-Business; organizations such as municipalities, schools, and law enforcement.

Services

Functions provided via SQribe, including uploading, transcribing, editing, and sharing media files.

GDPR

General Data Protection Regulation (EU 2016/679).

3. Access and Registration

• 3.1 Registration: Users must register with a valid email address. B2B users may use Single Sign-On via Azure Entra ID.
• 3.2 Age Restriction: Users must be at least 16 years old or have consent from a parent or legal guardian.
• 3.3 Account Security: You are responsible for securing your login credentials. Report unauthorized access immediately.

4. Services and Functionality

• Uploading and Transcribing: Users can upload audio/video files (up to 500 MB) for transcription via APIs like Whisper, Assembly AI, or Azure Speech-to-Text.
• Post-Processing with AI: Transcripts can be edited automatically using AI (e.g., GPT) for grammar, summaries, and translations.
• Agentic Templates: Users may select predefined templates to guide AI output (e.g., legal, medical).
• Sharing Transcripts: Transcripts can be downloaded as .txt, .pdf, or .docx files and shared.
• Admin Access: Admins have access to logs and metadata for monitoring and service improvement.

5. Usage Models and Payment

• Freemium: SQribe offers a free version with limited functionality.
• Paid Plans: Users may pay per use or via subscription. Subscriptions renew automatically unless cancelled.
• Cancellation: Subscriptions can be cancelled in accordance with applicable notice periods. Access remains until the end of the paid period.
• Refunds: Refunds are only granted for proven billing errors or when services could not be used due to technical issues. Requests must be made in writing within 14 days via hallo@aethiqs.nl.

6. Personal Data Processing

See our Privacy Statement for full details on what data we collect and how we use it. Key points include:

• Email and account details
• Uploaded audio/video files
• Transcript content
• Payment data
• Usage metadata (e.g., IP address, session logs)

All data is processed within the EU. B2B clients may request additional safeguards. Data can be deleted via the self-service portal.

7. Security

• Encryption in transit (TLS 1.2+) and at rest (AES-256)
• Multi-factor authentication for administrators
• Penetration and load testing
• Comprehensive audit logs

Only upload files you have the legal right to process. Do not upload secretly recorded material or personal data of third parties without valid legal basis. You are responsible for legal compliance.

8. Acceptable Use

You may only use SQribe for lawful purposes. It is strictly prohibited to:

• Upload illegal or covert recordings
• Process violent, hateful, or discriminatory content
• Use deepfake audio or malicious data inputs
• Abuse the system for unethical or deceptive purposes

We reserve the right to suspend or terminate accounts in case of violations.

9. Limitation of Liability

• No Accuracy Guarantee: SQribe does not guarantee the correctness of transcripts. Users are responsible for verifying content.
• Limited Liability: AethiQs is not liable for indirect damages, data loss, or transcription errors. Total liability is limited to the amount paid by the user in the 12 months preceding the incident.
• No Warranty: SQribe is provided "as is" without any warranties of fitness or availability.

10. Intellectual Property

• User Content: Users retain all rights to uploaded files and generated transcripts.
• License: By using SQribe, you grant AethiQs a limited license to process your content solely for the purpose of providing the service.

11. Changes and Termination

• Changes: We reserve the right to update these terms. Changes will be announced at least 30 days in advance.
• Termination: You may terminate your account at any time. We may terminate access for violations of these terms.

12. Governing Law and Dispute Resolution

• Governing Law: These terms are governed by Dutch law.
• Jurisdiction: Disputes will be submitted to the competent court in Rotterdam, The Netherlands.

13. Right of Withdrawal (B2C)

If you are a consumer, you may withdraw from paid services within 14 days of purchase, provided you have not yet used the service. To exercise this right, contact hallo@aethiqs.nl.

If the service has already been used in part, proportional charges may apply.
